– hereinafter referred to as “ROCOON”.
The offer is directed at both consumers and business customers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.
A business customer is a natural or legal person or a partnership with legal capacity acting in the course of its trade, business or self-employed professional activity when entering into the contract.
If a customer expressly places an order as a business customer and provides company details and, where applicable, a VAT identification number, the customer declares that the order is being placed for business purposes. The actual status as a consumer or business customer is determined by the applicable statutory requirements. Mandatory consumer rights are not excluded by the selection of a customer type.
2. Products and product information
The online shop offers in particular IOZER devices and related accessories or product packages.
The essential characteristics of each product are set out in the product description in the online shop and in the technical information and safety instructions linked there.
Technical documentation for IOZER products is available at docs.iozer.pro. The installation, safety and operating instructions applicable to the respective product must be observed.
Product images are for illustrative purposes. Minor visual deviations that do not affect functionality, safety or agreed characteristics are reserved.
3. Orders and conclusion of contract
The presentation of products in the online shop does not constitute a binding contractual offer by ROCOON.
Customers may place products in the shopping cart and review and correct their entries before submitting the order.
By clicking the “Place order with obligation to pay” button, the customer submits a binding offer to conclude a purchase contract for the products contained in the shopping cart.
An automatically generated acknowledgement of receipt sent immediately after the order has been placed does not yet constitute acceptance of the offer.
The contract is concluded when ROCOON either:
- expressly accepts the order by issuing an order confirmation, or
- confirms dispatch of the goods.
Where an electronic payment method results in an authorisation or charge before ROCOON accepts the order and ROCOON subsequently does not accept the order, any amount already collected will be refunded without undue delay.
ROCOON may reject orders for objectively justified reasons, in particular in the event of obvious pricing or product errors, lack of availability, failed payment processing or reasonable suspicion of misuse.
4. Contract language and storage
The contract languages are German and English.
Order information is stored to the extent required for statutory and operational purposes. Registered customers may view available order information in their customer account.
The GTC and the legally required consumer information are provided to the customer in a form that can be stored.
5. Prices and shipping costs
The prices displayed in the online shop at the time of the order apply.
Prices for consumers are displayed inclusive of the applicable VAT where VAT is chargeable.
Shipping costs may apply in addition. The specific shipping costs are displayed before the customer submits the order.
For deliveries to Switzerland, import VAT, customs duties and fees charged by customs, carriers or customs clearance providers may additionally apply. Unless such amounts are expressly charged by ROCOON during checkout, they are payable by the recipient.
6. Payment methods
The payment methods available for a particular order are displayed during checkout.
The following payment methods may currently be offered:
Advance payment:
The invoice amount must be transferred to the specified bank account within seven calendar days of the order confirmation. Unless otherwise stated, the delivery period begins once full payment has been received.
Purchase on account:
Where this payment method is offered, the invoice amount is due without deduction within 14 calendar days from the invoice date.
ROCOON may restrict purchase on account to certain customers or orders.
PayPal:
If PayPal is selected, payment is processed through PayPal. The terms of the relevant payment service provider also apply.
7. Delivery
ROCOON delivers to the countries available for selection in the online shop.
At market launch, deliveries are intended in particular to Austria, Germany and Switzerland.
For goods marked as in stock, the delivery time is generally up to seven working days unless a different delivery time is stated for the respective product.
Working days are Monday to Friday, excluding public holidays applicable at ROCOON’s registered office.
For advance payments, the delivery period begins upon receipt of full payment. For other payment methods, it begins upon conclusion of the contract.
Temporary business closures, including company holidays, are taken into account in the online shop. The delivery time shown before the order is placed is decisive.
If unforeseen delivery obstacles arise after conclusion of the contract, ROCOON will inform the customer without undue delay.
8. Shipping and transfer of risk
For consumers, the risk of accidental loss of or accidental damage to the goods generally passes only when the goods are handed over to the consumer or to a third party designated by the consumer.
This does not apply where the consumer independently commissions a carrier that was not offered by ROCOON.
For business customers, risk passes to the customer when the goods are handed over to the carrier or other person or organisation responsible for shipment.
9. Retention of title
The goods remain the property of ROCOON until payment has been made in full.
Business customers must inform ROCOON without undue delay if third parties seize goods subject to retention of title or assert rights in respect of such goods.
10. Installation, operation and safety
IOZER products are technical automation devices and must be used in accordance with the relevant technical documentation.
Installation, electrical connection and commissioning may only be carried out by appropriately qualified personnel.
IOZER basic may only be operated within the electrical and other operating limits specified for the product. In particular, direct connection to mains voltage is not permitted.
The applicable safety instructions and technical limits are described in the product documentation supplied with the product or made available online.
The customer is responsible for selecting, planning, installing and configuring the product correctly for the specific application.
IOZER must not be used as a substitute for legally or technically required safety, protective or emergency-stop equipment unless the particular product has been expressly approved for such a function.
Statutory warranty and liability claims arising from a defect for which ROCOON is responsible remain unaffected.
11. Firmware, updates and digital elements
IOZER products contain firmware and/or digital elements required for the operation of the device.
ROCOON provides firmware updates and, in particular, required security updates for supported devices in accordance with statutory obligations and the published support information.
Depending on the product and firmware version, firmware updates may be installed in particular:
- using the device’s update function,
- via IOZER connect, or
- by manually uploading a provided firmware file.
Registration with IOZER connect is not required for the general availability of firmware updates.
The published security support period is stated in the IOZER documentation. Statutory update obligations remain unaffected.
The customer is responsible for installing updates that are provided and required for contractual conformity or security within a reasonable period of time and for following the installation instructions provided.
12. Rights of use for firmware and software
By purchasing an IOZER device, the customer receives a non-exclusive right to use the firmware provided on or for the device for its intended purpose together with the respective product.
Distribution, reproduction or modification of proprietary software components independently of the device is permitted only where expressly authorised by ROCOON or where mandatory statutory provisions permit it.
Open-source components are governed primarily by the applicable open-source licence terms.
Mandatory statutory rights, in particular relating to interoperability, troubleshooting or software analysis, remain unaffected.
13. Warranty
For consumers, the statutory warranty provisions apply, in particular the provisions concerning goods and goods with digital elements.
ROCOON currently does not provide a general voluntary manufacturer’s guarantee in addition to statutory rights unless expressly stated otherwise for a particular product.
For business customers, the statutory warranty rules apply together with the applicable commercial inspection and notification obligations.
Business customers must inspect the goods upon receipt in accordance with Section 377 of the Austrian Commercial Code (UGB) and notify ROCOON of identified defects within a reasonable period.
No warranty claims arise for impairments caused exclusively by improper installation, use outside the specified operating conditions, impermissible electrical connection, unauthorised modifications or other interventions attributable to the customer.
14. Liability
ROCOON is liable to consumers in accordance with statutory provisions.
Mandatory liability provisions, in particular product liability law and liability for personal injury, remain unaffected.
In relation to business customers, ROCOON is liable for intent and gross negligence. To the extent permitted by law, liability for slight negligence exists only for breaches of material contractual obligations and is in such cases limited to the damage typically foreseeable.
In relation to business customers, liability for indirect damage, consequential damage, loss of profit or production downtime is excluded to the extent permitted by law unless such damage was caused intentionally or by gross negligence.
ROCOON is not liable for damage caused exclusively by use contrary to the intended purpose, incorrect planning or configuration by the customer or failure to comply with mandatory safety and installation requirements.
15. Right of withdrawal for consumers
Consumers are entitled to the statutory right of withdrawal for distance contracts unless a statutory exception applies.
Further details are set out in the separate Withdrawal Information.
ROCOON voluntarily grants consumers with a delivery address in Switzerland a corresponding 14-day right of withdrawal under the conditions described in the Withdrawal Information unless otherwise specified for the respective product.
For orders with free return shipping promised under the launch promotion, ROCOON bears standard return shipping costs and provides a prepaid Post parcel label, including for statutory withdrawal. For other orders the consumer bears direct return costs unless agreed otherwise or required by law.
This does not apply to returns made on the basis of justified warranty or other statutory claims where ROCOON is legally required to bear the return costs.
16. Data protection
Information on the processing of personal data is provided in the separate Privacy Notice for the online shop.
17. Applicable law
Austrian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For contracts with consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the country in which the consumer has their habitual residence.
18. Jurisdiction
For contracts with business customers, the court having subject-matter jurisdiction at ROCOON’s registered office shall have exclusive jurisdiction to the extent permitted by law.
For consumers, the statutory rules on jurisdiction apply.
19. Alternative dispute resolution
ROCOON does not voluntarily participate in proceedings before a consumer dispute resolution body unless participation is required by law.
Statutory information obligations relating to a specific unresolved consumer dispute remain unaffected.
20. Final provisions
Individual agreements between ROCOON and the customer take precedence over these GTC.
If individual provisions of these GTC are or become invalid, the validity of the remaining provisions is unaffected. The applicable statutory provisions shall apply in place of any invalid provision.
Voluntary 30-day return right
Voluntary 30-day free returns — launch promotion
The voluntary 30-day return right is additional to your statutory rights and does not restrict your statutory right of withdrawal or your legal guarantee rights.
For consumer orders for physical goods delivered to Austria or Germany and placed while the promotion is active from 1 October 2026. Business orders are excluded unless individually agreed otherwise. The promise recorded with your order remains valid if the promotion ends later.
Declare your return within 30 days of receiving the goods and send them back within 14 days of your declaration. Use the online return function or contact ROCOON by email or post. No reason is required.
Days 1–14: the statutory withdrawal rules apply without restriction. The additional conditions below must not be applied to statutory withdrawal, including where a statutory withdrawal period lasts longer.
Days 15–30: ROCOON handles the return under this voluntary right. For this voluntary right after the statutory withdrawal period, goods must be complete, functional and free from damage or substantial signs of use beyond normal inspection. Please include the original packaging and accessories where possible. Original packaging is not a requirement for statutory withdrawal.
ROCOON provides a prepaid standard return label (Post parcel label), sent separately by our team. Standard return shipping is free, including statutory withdrawal for qualifying promotional orders.
We refund the purchase price of the returned goods and the cost of the least expensive standard delivery offered. Additional costs for expressly selected express, special or premium delivery are not refunded.
This is a voluntary return right, not an extension of the statutory withdrawal period and not a manufacturer's guarantee.
